Terms of Service
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Contractor," "you," or "your") and KRCA LLC, doing business as Roffy ("Roffy," "we," "us," or "our"), a North Carolina limited liability company operating at roffy.io. By accessing or using our platform, creating an account, or purchasing leads, you agree to be bound by these Terms in full. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing roffy.io, clicking "I Agree," creating an account, or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a business entity, you represent that you have the authority to bind that entity, and "you" refers to both you individually and the entity.
Your continued use of the Service after any modifications to these Terms constitutes acceptance of the revised Terms.
2. Service Description
Roffy is a business-to-business (B2B) lead generation platform that provides roofing contractors with leads for potential roof replacement and repair projects. Our Service includes:
- Identification of properties with potential roofing needs using publicly available data sources including public records, county assessor databases, building permit filings, satellite and aerial imagery analysis, and people-search databases.
- Compilation of lead data including property addresses, estimated roof conditions, homeowner contact information, and confidence scoring.
- Delivery of leads through the Roffy platform dashboard and/or via electronic export.
Roffy does not perform roofing work, provide roofing estimates, or act as a broker between homeowners and contractors. We are a data and lead generation service only.
3. Account Registration and Contractor Responsibilities
3.1 Eligibility
The Service is intended for licensed roofing contractors and roofing businesses operating within the United States. By registering, you represent that you are at least 18 years of age, legally authorized to do business in your operating jurisdiction, and hold any required contractor licenses.
3.2 Account Information
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials. You are solely responsible for all activity that occurs under your account.
3.3 Contractor Responsibilities
You are solely responsible for:
- Complying with all applicable federal, state, and local laws when contacting leads, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable Do Not Call (DNC) regulations.
- Maintaining any required business licenses, contractor licenses, insurance, and bonding in your operating areas.
- The manner, timing, and content of all communications you initiate with leads.
- Maintaining your own DNC suppression lists and honoring opt-out requests.
4. Pricing, Payment Terms, and Billing
4.1 Pricing Tiers
Roffy offers the following service tiers. Prices are subject to change with notice:

4.2 Payment Processing
All payments are processed securely through Stripe. By providing payment information, you authorize Roffy and Stripe to charge the applicable fees to your designated payment method. Roffy does not store your full credit card details on our servers.
4.3 Billing
- One-time purchases are charged at the time of order.
- Monthly subscriptions are billed on a recurring basis on the same calendar day each month. If the original billing day does not exist in a given month, billing occurs on the last day of that month.
- All fees are in U.S. dollars and are non-refundable except as expressly stated in Section 5 (Lead Quality Guarantee).
4.4 Failed Payments
If a payment fails, we may retry the charge and/or suspend your account and lead delivery until the balance is resolved. Continued failure to pay may result in account termination.
5. Lead Delivery and Quality Guarantee
5.1 Lead Delivery
Leads are delivered through the Roffy platform in accordance with the specifications of your selected tier. Delivery timelines depend on geographic availability, tier selection, and market conditions. Roffy does not guarantee a specific delivery date or volume unless explicitly stated in a separate written agreement.
5.2 Lead Quality Guarantee
Roffy stands behind the quality of the leads we deliver. If you believe a lead is materially defective (e.g., the property does not exist, the contact information is entirely fabricated, or the property has no roof), you may report the issue within seven (7) calendar days of lead delivery.
5.3 What Does Not Qualify for Replacement
The following are not considered lead quality issues and do not qualify for replacements:
- The homeowner did not answer the phone or respond to outreach.
- The homeowner answered but expressed no interest in roofing services.
- The homeowner already had work completed or chose a different contractor.
- The Contractor failed to contact the lead within a reasonable timeframe.
- The lead information was accurate but the Contractor was unsatisfied with the outcome of their sales effort.
- Issues reported after the 7-day reporting window has closed.
6. Exclusivity and Lockout Periods
Depending on your tier, leads delivered to you are subject to an exclusivity lockout period during which the same lead will not be sold to another contractor in your service area:

After the lockout period expires, Roffy reserves the right to include that lead data in orders for other contractors. Exclusivity applies only to the specific geographic territory and lead data delivered; it does not prevent other contractors from independently identifying the same property through their own means.
7. Acceptable Use Policy
When using leads obtained through Roffy, you agree to:
- Comply with all applicable federal, state, and local laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all Do Not Call (DNC) regulations.
- Check all phone numbers against the National Do Not Call Registry and any applicable state DNC lists before initiating telephone solicitation.
- Honor all opt-out, unsubscribe, and do-not-contact requests promptly.
- Identify yourself and your company accurately in all communications with leads.
- Use leads solely for the purpose of offering legitimate roofing services.
- Maintain records of your outreach activities as required by law.
8. Prohibited Uses
You expressly agree not to:
- Redistribute, resell, sublicense, or share leads obtained through Roffy with any third party, including other contractors, lead aggregators, or marketing companies.
- Use leads for any purpose other than offering roofing or related home improvement services.
- Harass, threaten, or engage in abusive conduct toward any individual whose information is included in a lead.
- Use automated dialing systems, robocalls, or pre-recorded messages to contact leads in violation of the TCPA.
- Send unsolicited commercial email in violation of the CAN-SPAM Act.
- Contact leads using any method prohibited by applicable law.
- Attempt to reverse-engineer, scrape, or extract Roffy's proprietary data, algorithms, or systems.
- Use the Service to compete with Roffy or to build a competing product or service.
- Access the Service using automated bots, scripts, or crawlers without prior written consent.
Violation of this section may result in immediate account termination without refund, and you may be held liable for any resulting damages.
9. Data Accuracy Disclaimer
Leads provided through Roffy are compiled from publicly available data sources including, but not limited to, public property records, county assessor databases, building permit records, satellite and aerial imagery, and commercially available people-search databases.
Roffy does not guarantee the accuracy, completeness, or currentness of any lead data. Property conditions may have changed since the data was collected. Homeowner contact information may be outdated. Roof condition assessments are estimates based on available data and imagery, not physical inspections.
Leads are provided on an "as-is" and "as-available" basis. While we employ reasonable measures to verify data quality, the nature of public-record data means that some inaccuracies are inevitable. Your exclusive remedy for lead quality issues is the replacement policy described in Section 5.
10. Intellectual Property
All content, features, functionality, software, data compilations, algorithms, scoring models, branding, trademarks, and trade dress associated with roffy.io and the Roffy platform are the exclusive property of KRCA LLC (d/b/a Roffy) or its licensors and are protected by United States and international intellectual property laws.
Your purchase of leads grants you a limited, non-exclusive, non-transferable license to use the delivered lead data solely for the purpose of contacting potential customers for your roofing business. This license does not include the right to reproduce, redistribute, or create derivative works from the data, nor does it grant any rights to Roffy's underlying technology, algorithms, or methods.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- ROFFY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO ROFFY IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
- IN NO EVENT SHALL ROFFY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF DATA, OR REPUTATIONAL HARM, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ROFFY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- ROFFY IS NOT LIABLE FOR ANY FINES, PENALTIES, OR DAMAGES ARISING FROM YOUR FAILURE TO COMPLY WITH APPLICABLE LAWS, INCLUDING THE TCPA, CAN-SPAM ACT, OR DNC REGULATIONS, WHEN CONTACTING LEADS.
- ROFFY IS NOT LIABLE FOR ANY CLAIMS, DAMAGES, OR LOSSES ARISING FROM THE ACTIONS OR OMISSIONS OF HOMEOWNERS OR PROPERTY OWNERS INCLUDED IN LEADS.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Roffy's liability is limited to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless KRCA LLC (d/b/a Roffy), its officers, directors, members, employees, agents, and affiliates from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service or any lead data provided through the Service.
- Your violation of these Terms.
- Your violation of any applicable law, regulation, or third-party right, including but not limited to the TCPA, CAN-SPAM Act, and DNC regulations.
- Any communications, solicitations, or other contacts you initiate with leads obtained through the Service.
- Any claims by homeowners, property owners, or other third parties arising from your outreach activities.
- Your negligence or willful misconduct.
This indemnification obligation survives the termination of your account and these Terms.
13. Termination
13.1 Termination by You
You may cancel your account at any time by contacting us at hello@roffy.io. For monthly subscriptions, cancellation takes effect at the end of the current billing cycle. No refunds are issued for partial billing periods or unused leads.
13.2 Termination by Roffy
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Grounds for immediate termination include, but are not limited to:
- Violation of these Terms, including the Acceptable Use Policy or Prohibited Uses.
- Redistribution or resale of lead data.
- Non-payment or repeated payment failures.
- Fraudulent or abusive conduct.
- Any activity that, in our sole judgment, poses a legal or reputational risk to Roffy.
13.3 Effect of Termination
Upon termination, your right to access the Service and use any uncontacted leads ceases immediately. Sections that by their nature should survive termination (including Sections 8, 10, 11, 12, 14, 15, and 17) shall survive.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to contact Roffy at hello@roffy.io and attempt to resolve the dispute informally for at least thirty (30) days.
14.2 Binding Arbitration
If a dispute cannot be resolved informally, you and Roffy agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration conducted in Mooresville, North Carolina, in accordance with the rules of the American Arbitration Association (AAA). The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
14.3 Class Action Waiver
YOU AND ROFFY AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
14.4 Exceptions
Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction in Iredell County, North Carolina, to protect intellectual property rights or to prevent irreparable harm.
15. Governing Law
These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. To the extent that litigation is permitted under these Terms, the exclusive venue shall be the state and federal courts located in Iredell County, North Carolina, and you consent to personal jurisdiction in such courts.
16. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy and any separate written agreements executed between you and Roffy, constitute the entire agreement between you and Roffy regarding the Service. These Terms supersede all prior agreements, representations, warranties, and understandings, whether written, oral, or implied, relating to the subject matter herein.
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Roffy's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
18. Changes to Terms
Roffy reserves the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we will make reasonable efforts to notify you via email or through a notice on the platform.
Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your account.
